Guatemala City. Ex- General Oscar Humberto Mejia Victores, former head of state of Guatemala, accused of genocide and other crimes against humanity, is unable to stand trial because of health reasons according to Judge Carol Patricia Flores, First Tribunal. She announced that the case is not closed, but is suspended indefinitely. The former head of state, in psychiatric terms, has a clinical picture of organic mental disorder due to a cerebral vascular ischemia.
Because of the health problem, Mejía Victores is unable to express himself verbally. He also presents limitations of understanding, according to the report of forensic medics from INACIF.
Mejía was taken as a detainee to the Military Hospital (Zone 16), on October 25, 2011, after the judge failed to take the first statement at his home, according to the Defense Attorney; Mejia Victores was suffering from symptoms of an alleged stroke that affected him months ago.
The former head of state was declared fugitive of the law and was arraigned on October 17, 2011.
Óscar Humberto Mejía, who served first as Deputy Minister of Defense in charge of the office of the Ministry of National Defense and then as National Minister of Defense, is accused of crimes against humanity and genocide, he allegedly ordered the execution of massacres in the Ixil Triangle and in Plan de Sanchez, Baja Verapaz, recorded during 1982 and 1984.
He faces charges of the crimes of murder and crimes against humanity for allegedly ordering the killing of more than 170 victims in the community Dos Erres, Petén, and the killing of 1.171 people in the Ixil Triangle.
According to the Public Ministry (MP), Mejía could have been a member of the military forces responsible for having planned and developed military actions aimed at countering the insurgency during the internal armed conflict.
